'13 Sportster Salvage

I am curious about rights regarding a wrecked bike.

I got off my Son's '13 Sportster on 7/11. I didn't see the bike, as I was waiting for the trauma hawk.
Got off about 80 mph flat street. I was pretty lucky, broke all the ribs on left side, clavicle and scapula both broke. They surgeried a plate in me on 7/20.

so I'm just waiting for the ribs to heal :)

I saw pics of the bike today, doesn't look that bad. They (Geico) are totaling it. Bike has been punched-out to 1,200 and has a cam, power commander tuner as upgrades. I would say the damage isn't over $1,500 in parts. Not much in labor, either.

Does the owner have any rights as to first refusal?

Once the insurance company pays the claim and you accept, the bike now belongs to them. Maybe make them a offer it can't hurt, otherwise most ins co have outlets to get rid of them.
